  中共(gong)中央辦(ban)公廳、國務院辦(ban)公廳近(jin)日印發了(le)《行(xing)業(ye)協會商會與行(xing)政機關脫鉤總體方案》,并(bing)發出通(tong)知(zhi),要求各(ge)地區各(ge)部門結(jie)合實際(ji)認(ren)真(zhen)貫徹(che)執行(xing)。

  《行(xing)業(ye)協會(hui)商(shang)會(hui)與(yu)行(xing)政機關(guan)脫(tuo)鉤總體方(fang)案》全文(wen)如下(xia)。

  行業(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)是我國經濟建(jian)設和(he)(he)社(she)(she)會(hui)(hui)(hui)發(fa)(fa)展的(de)(de)重要力量。改革(ge)(ge)開放(fang)以來,隨著社(she)(she)會(hui)(hui)(hui)主義市場經濟體制(zhi)的(de)(de)建(jian)立和(he)(he)完善,行業(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)發(fa)(fa)展迅速,在為(wei)政(zheng)(zheng)府(fu)提供咨詢(xun)、服務企(qi)業(ye)(ye)發(fa)(fa)展、優化(hua)資源配置、加強行業(ye)(ye)自律、創新(xin)社(she)(she)會(hui)(hui)(hui)治理、履行社(she)(she)會(hui)(hui)(hui)責(ze)任等(deng)(deng)方面發(fa)(fa)揮(hui)了積極作用。目前,一些(xie)行業(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)還存在政(zheng)(zheng)會(hui)(hui)(hui)不分、管辦一體、治理結構(gou)不健全、監督管理不到位、創新(xin)發(fa)(fa)展不足、作用發(fa)(fa)揮(hui)不夠等(deng)(deng)問題。按照(zhao)《中共中央關(guan)于全面深化(hua)改革(ge)(ge)若干重大問題的(de)(de)決定》、《國務院(yuan)機(ji)構(gou)改革(ge)(ge)和(he)(he)職能轉變(bian)方案》有(you)關(guan)精(jing)神(shen)和(he)(he)工作部署,為(wei)加快轉變(bian)政(zheng)(zheng)府(fu)職能,實現(xian)行業(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)與(yu)行政(zheng)(zheng)機(ji)關(guan)脫鉤(gou),促進行業(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)規(gui)范(fan)發(fa)(fa)展,制(zhi)定本方案。

  一(yi)、總(zong)體要(yao)求和基(ji)本原則

  (一)總體要求

  貫徹落實黨的(de)(de)(de)十八(ba)大(da)和(he)(he)十八(ba)屆(jie)二中(zhong)、三中(zhong)、四中(zhong)全會(hui)(hui)(hui)(hui)(hui)(hui)(hui)精神,加(jia)快(kuai)形成政社(she)分開、權責明確、依法(fa)自治(zhi)(zhi)的(de)(de)(de)現代社(she)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)組織體制(zhi),理清(qing)政府、市場、社(she)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)關(guan)系(xi),積極穩(wen)妥推進(jin)行(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)與(yu)行(xing)政機關(guan)脫鉤,厘清(qing)行(xing)政機關(guan)與(yu)行(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)的(de)(de)(de)職能(neng)邊(bian)界,加(jia)強綜合監管和(he)(he)黨建工作(zuo)(zuo),促(cu)進(jin)行(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)成為依法(fa)設(she)立、自主(zhu)辦會(hui)(hui)(hui)(hui)(hui)(hui)(hui)、服務為本、治(zhi)(zhi)理規范(fan)、行(xing)為自律的(de)(de)(de)社(she)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)組織。創新行(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)管理體制(zhi)和(he)(he)運(yun)行(xing)機制(zhi),激發(fa)內(nei)在(zai)活力和(he)(he)發(fa)展動力,提升行(xing)業(ye)服務功能(neng),充分發(fa)揮行(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)在(zai)經濟發(fa)展新常態(tai)中(zhong)的(de)(de)(de)獨特優勢和(he)(he)應有作(zuo)(zuo)用。

  (二)基本原則

  堅(jian)持社(she)會(hui)(hui)化(hua)(hua)、市場(chang)化(hua)(hua)改革方向。圍繞使市場(chang)在(zai)資(zi)源(yuan)配置中起決定性作用和更(geng)好發揮政府作用,改革傳(chuan)統的(de)行(xing)(xing)政化(hua)(hua)管理(li)方式,按照去行(xing)(xing)政化(hua)(hua)的(de)要求,切斷行(xing)(xing)政機(ji)關(guan)和行(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)之間的(de)利益(yi)鏈條,建立新(xin)型管理(li)體制(zhi)和運(yun)行(xing)(xing)機(ji)制(zhi),促進和引導行(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)自主運(yun)行(xing)(xing)、有序競爭、優化(hua)(hua)發展。

  堅持法(fa)制(zhi)化、非營利(li)原則(ze)。加(jia)快行(xing)(xing)業協會(hui)(hui)商(shang)會(hui)(hui)法(fa)律制(zhi)度建設,明確脫鉤后的法(fa)律地位,實(shi)現依法(fa)規范運行(xing)(xing)。建立準入和(he)退出機制(zhi),健全綜合(he)監管體系。各(ge)級政(zheng)府要(yao)明確權(quan)(quan)力(li)邊(bian)界,實(shi)現權(quan)(quan)力(li)責任統(tong)一、服務(wu)監管并重(zhong)。按(an)照非營利(li)原則(ze)要(yao)求,規范行(xing)(xing)業協會(hui)(hui)商(shang)會(hui)(hui)服務(wu)行(xing)(xing)為,發(fa)揮對(dui)會(hui)(hui)員(yuan)的行(xing)(xing)為引導、規則(ze)約束和(he)權(quan)(quan)益維護作用。

  堅持(chi)服務(wu)發(fa)展、釋放市場活力。提(ti)升行業(ye)(ye)(ye)(ye)(ye)協(xie)會商會專業(ye)(ye)(ye)(ye)(ye)化水平(ping)和能力,推動服務(wu)重(zhong)心從政府轉(zhuan)向企(qi)業(ye)(ye)(ye)(ye)(ye)、行業(ye)(ye)(ye)(ye)(ye)、市場。通過提(ti)供(gong)指導(dao)、咨詢、信(xin)息等服務(wu),更好地為(wei)企(qi)業(ye)(ye)(ye)(ye)(ye)、行業(ye)(ye)(ye)(ye)(ye)提(ti)供(gong)智力支撐,規(gui)范市場主體行為(wei),引導(dao)企(qi)業(ye)(ye)(ye)(ye)(ye)健康有序(xu)發(fa)展,促進產(chan)業(ye)(ye)(ye)(ye)(ye)提(ti)質增效升級。

  堅持(chi)試點先行、分(fen)步穩妥推(tui)進(jin)。在中(zhong)央(yang)和(he)地(di)方分(fen)別(bie)開展試點,設置必要的(de)過(guo)渡(du)期,積極探(tan)索,總(zong)結經驗,完善措(cuo)施,逐步推(tui)開。根據行業協會商會不同情況,因(yin)地(di)因(yin)業因(yin)會逐個縝(zhen)密制定脫鉤(gou)實(shi)施方案,具(ju)體安排、具(ju)體指導、具(ju)體把握,確保脫鉤(gou)工作平穩過(guo)渡(du)、有(you)序(xu)推(tui)進(jin)。

  二、脫鉤主體和范圍

  脫(tuo)鉤(gou)的(de)主體是各級行(xing)政機關與其(qi)主辦、主管(guan)、聯(lian)(lian)系(xi)、掛靠的(de)行(xing)業(ye)協會(hui)商(shang)會(hui)。其(qi)他依(yi)照(zhao)(zhao)和參(can)照(zhao)(zhao)公(gong)務員法(fa)管(guan)理的(de)單位與其(qi)主辦、主管(guan)、聯(lian)(lian)系(xi)、掛靠的(de)行(xing)業(ye)協會(hui)商(shang)會(hui),參(can)照(zhao)(zhao)本(ben)方(fang)案執(zhi)行(xing)。

  同(tong)時具有以(yi)下特(te)征的(de)行業協(xie)會(hui)(hui)商會(hui)(hui)納入脫(tuo)鉤范圍(wei):會(hui)(hui)員主體為從(cong)事相同(tong)性質經(jing)濟(ji)活動的(de)單(dan)位、同(tong)業人員,或同(tong)地(di)域(yu)的(de)經(jing)濟(ji)組織;名稱以(yi)“行業協(xie)會(hui)(hui)”、“協(xie)會(hui)(hui)”、“商會(hui)(hui)”、“同(tong)業公會(hui)(hui)”、“聯(lian)合會(hui)(hui)”、“促進會(hui)(hui)”等字樣(yang)為后綴(zhui);在民政部(bu)門登記(ji)為社(she)會(hui)(hui)團體法人。

  個別承擔特殊職能(neng)的全國性行(xing)業協會(hui)(hui)商會(hui)(hui),經中(zhong)央辦公廳、國務院辦公廳批準,另行(xing)制定改革辦法。

  三、脫(tuo)鉤任務和措施(shi)

  (一)機構分離,規范綜合監管關(guan)系

  取消行(xing)(xing)政機關(guan)(包括(kuo)下屬(shu)單(dan)位)與(yu)行(xing)(xing)業協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)的主(zhu)辦、主(zhu)管、聯系和掛靠關(guan)系。行(xing)(xing)業協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)依(yi)(yi)法直接登記和獨立運行(xing)(xing)。行(xing)(xing)政機關(guan)依(yi)(yi)據職(zhi)能(neng)對行(xing)(xing)業協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)提(ti)供(gong)服(fu)務并(bing)依(yi)(yi)法監管。 

  依(yi)法保障行(xing)(xing)業協會(hui)商(shang)會(hui)獨立平等法人地位。按照有利于行(xing)(xing)業發展和(he)自愿互惠原則,對(dui)行(xing)(xing)業協會(hui)商(shang)會(hui)之(zhi)間(jian)、行(xing)(xing)業協會(hui)商(shang)會(hui)與其他社會(hui)組(zu)織之(zhi)間(jian)的代管協管掛靠關系進行(xing)(xing)調整,并納入章(zhang)程予以(yi)規范。鼓勵行(xing)(xing)業協會(hui)商(shang)會(hui)優化整合,提高服務效率和(he)水(shui)平。

  調(diao)整(zheng)行業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)與其代管(guan)(guan)(guan)(guan)的(de)(de)事(shi)業(ye)(ye)(ye)單(dan)位的(de)(de)關(guan)(guan)系。行業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)代管(guan)(guan)(guan)(guan)的(de)(de)事(shi)業(ye)(ye)(ye)單(dan)位,并(bing)入行業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)的(de)(de),注(zhu)銷事(shi)業(ye)(ye)(ye)單(dan)位法人資格,核銷事(shi)業(ye)(ye)(ye)編制,并(bing)入人員按照行業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)人員管(guan)(guan)(guan)(guan)理(li)(li)方式(shi)管(guan)(guan)(guan)(guan)理(li)(li);不能并(bing)入行業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)的(de)(de),應當與行業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)脫鉤(gou),根據業(ye)(ye)(ye)務(wu)關(guan)(guan)聯性(xing),在精(jing)簡的(de)(de)基(ji)礎上劃轉(zhuan)到相關(guan)(guan)行業(ye)(ye)(ye)管(guan)(guan)(guan)(guan)理(li)(li)部(bu)門管(guan)(guan)(guan)(guan)理(li)(li),并(bing)納入事(shi)業(ye)(ye)(ye)單(dan)位分類改革。

  行政(zheng)機關或(huo)事業(ye)單位與(yu)行業(ye)協會商會合(he)署(shu)辦公的(de),逐步將機構、人員和資產分開,行政(zheng)機關或(huo)事業(ye)單位不再(zai)承擔行業(ye)協會商會職能。 

  (二)職(zhi)能分(fen)(fen)離(li),規范行(xing)政委(wei)托(tuo)和職(zhi)責分(fen)(fen)工關系

  厘清行(xing)(xing)政(zheng)機(ji)關與(yu)行(xing)(xing)業協會(hui)商(shang)會(hui)的職(zhi)能(neng)(neng)(neng)。剝離(li)行(xing)(xing)業協會(hui)商(shang)會(hui)現有(you)(you)的行(xing)(xing)政(zheng)職(zhi)能(neng)(neng)(neng),法律法規(gui)另有(you)(you)規(gui)定的除(chu)外。業務主管(guan)單(dan)位(wei)對剝離(li)行(xing)(xing)業協會(hui)商(shang)會(hui)有(you)(you)關行(xing)(xing)政(zheng)職(zhi)能(neng)(neng)(neng)提出具體意見。

  加(jia)快轉移適合(he)由行(xing)業協會(hui)商(shang)(shang)會(hui)承(cheng)擔(dan)的職能。行(xing)政機關對適合(he)由行(xing)業協會(hui)商(shang)(shang)會(hui)承(cheng)擔(dan)的職能,制定清單目錄,按程序移交行(xing)業協會(hui)商(shang)(shang)會(hui)承(cheng)擔(dan),并(bing)制定監(jian)管(guan)措施(shi)、履行(xing)監(jian)管(guan)責(ze)任(ren)。

  (三)資產財(cai)務分離,規范財(cai)產關系

  行業(ye)協會(hui)(hui)商會(hui)(hui)應執(zhi)行民(min)間非營(ying)利組(zu)織會(hui)(hui)計制(zhi)度,單獨建賬(zhang)(zhang)、獨立核算。沒有獨立賬(zhang)(zhang)號、與行政機關會(hui)(hui)計合賬(zhang)(zhang)、財(cai)務由行政機關代管或集(ji)中管理的行業(ye)協會(hui)(hui)商會(hui)(hui),要設立獨立賬(zhang)(zhang)號,單獨核算,實行獨立財(cai)務管理。

  對原(yuan)有財政(zheng)預算支持的全國性(xing)行(xing)(xing)業協會(hui)商(shang)會(hui),逐步通過(guo)政(zheng)府(fu)購買服務等方式(shi)支持其發展(zhan)。自2018年起,取消全國性(xing)行(xing)(xing)業協會(hui)商(shang)會(hui)的財政(zheng)直接撥(bo)(bo)(bo)款,在此之前,保留原(yuan)有財政(zheng)撥(bo)(bo)(bo)款經費渠道不(bu)變。為鼓勵全國性(xing)行(xing)(xing)業協會(hui)商(shang)會(hui)加快(kuai)與(yu)行(xing)(xing)政(zheng)機(ji)關脫鉤(gou),過(guo)渡(du)(du)期(qi)(qi)內根據脫鉤(gou)年份,財政(zheng)直接撥(bo)(bo)(bo)款額度(du)逐年遞減。地方性(xing)行(xing)(xing)業協會(hui)商(shang)會(hui)的財政(zheng)撥(bo)(bo)(bo)款過(guo)渡(du)(du)期(qi)(qi)和過(guo)渡(du)(du)辦法,由各地自行(xing)(xing)確(que)定(ding)(ding),但過(guo)渡(du)(du)期(qi)(qi)不(bu)得超過(guo)2017年底。用于(yu)安置(zhi)歷次(ci)政(zheng)府(fu)機(ji)構改(gai)革分流人員的財政(zheng)資金(jin),仍按原(yuan)規(gui)定(ding)(ding)執行(xing)(xing)。

  按照財(cai)(cai)政部門、機(ji)關事務主(zhu)管(guan)(guan)部門統一部署和有(you)關規定,各業(ye)(ye)務主(zhu)管(guan)(guan)單位對其(qi)主(zhu)管(guan)(guan)的行(xing)(xing)業(ye)(ye)協會(hui)(hui)商(shang)(shang)會(hui)(hui)財(cai)(cai)務資(zi)產狀(zhuang)況進行(xing)(xing)全面摸底和清查(cha)登記(ji),厘清財(cai)(cai)產歸屬。財(cai)(cai)政部門會(hui)(hui)同(tong)(tong)機(ji)關事務主(zhu)管(guan)(guan)部門按照所有(you)權、使(shi)(shi)用(yong)(yong)權相分離(li)的原則,制定行(xing)(xing)業(ye)(ye)協會(hui)(hui)商(shang)(shang)會(hui)(hui)使(shi)(shi)用(yong)(yong)國(guo)(guo)有(you)資(zi)產(包括無形資(zi)產)管(guan)(guan)理(li)辦(ban)法,確(que)保(bao)國(guo)(guo)有(you)資(zi)產不流失(shi),同(tong)(tong)時確(que)保(bao)行(xing)(xing)業(ye)(ye)協會(hui)(hui)商(shang)(shang)會(hui)(hui)的正(zheng)常運行(xing)(xing)和發展。

  行(xing)業協會(hui)商會(hui)占用(yong)(yong)的(de)(de)(de)行(xing)政辦(ban)公(gong)(gong)用(yong)(yong)房,超出規(gui)定(ding)面積標準的(de)(de)(de)部分限期清理騰退;符合(he)規(gui)定(ding)面積標準的(de)(de)(de)部分暫(zan)由(you)行(xing)業協會(hui)商會(hui)使用(yong)(yong),2017年底前(qian)按《中共(gong)中央辦(ban)公(gong)(gong)廳、國務院(yuan)辦(ban)公(gong)(gong)廳關(guan)于黨政機關(guan)停止新(xin)建(jian)樓(lou)堂館所和清理辦(ban)公(gong)(gong)用(yong)(yong)房的(de)(de)(de)通(tong)知》及有(you)關(guan)規(gui)定(ding)清理騰退,原則上(shang)應實現辦(ban)公(gong)(gong)場所獨立。具體辦(ban)法由(you)機關(guan)事務主(zhu)管(guan)部門(men)會(hui)同(tong)有(you)關(guan)部門(men)制定(ding)。

  (四)人(ren)(ren)員管理分離(li),規(gui)范用人(ren)(ren)關系

  行業協(xie)會(hui)商會(hui)具有人事自主(zhu)權(quan),在人員管理(li)上與原主(zhu)辦、主(zhu)管、聯系和(he)掛靠單位脫(tuo)鉤,依(yi)法依(yi)規建(jian)立規范用人制度,逐步(bu)實行依(yi)章程自主(zhu)選人用人。

  行(xing)(xing)政機關(guan)不(bu)得(de)推薦、安排在(zai)職(zhi)和退(tui)(離(li)(li))休(xiu)公務員到(dao)行(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)任(ren)職(zhi)兼(jian)(jian)(jian)職(zhi)。現職(zhi)和不(bu)擔任(ren)現職(zhi)但未(wei)辦理退(tui)(離(li)(li))休(xiu)手續的(de)黨政領導干部及在(zai)職(zhi)工作人(ren)員,不(bu)得(de)在(zai)行(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)兼(jian)(jian)(jian)任(ren)職(zhi)務。領導干部退(tui)(離(li)(li))休(xiu)后(hou)三年內一般(ban)不(bu)得(de)到(dao)行(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)兼(jian)(jian)(jian)職(zhi),個(ge)別(bie)確(que)屬工作特殊需要(yao)兼(jian)(jian)(jian)職(zhi)的(de),應當按照干部管(guan)理權(quan)(quan)限審批;退(tui)(離(li)(li))休(xiu)三年后(hou)到(dao)行(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)兼(jian)(jian)(jian)職(zhi),須按干部管(guan)理權(quan)(quan)限審批或備案后(hou)方(fang)可(ke)兼(jian)(jian)(jian)職(zhi)。

  對已在(zai)(zai)行業(ye)協會商會中任(ren)職(zhi)(zhi)(zhi)、兼(jian)職(zhi)(zhi)(zhi)的公(gong)務員,按(an)相(xiang)關(guan)規定進行一次性清理(li)。任(ren)職(zhi)(zhi)(zhi)的在(zai)(zai)職(zhi)(zhi)(zhi)公(gong)務員,脫鉤后自愿選擇去留(liu)(liu):退出行業(ye)協會商會工(gong)作的,由所(suo)屬(shu)行政機(ji)關(guan)妥(tuo)善安置;本人自愿繼續留(liu)(liu)在(zai)(zai)行業(ye)協會商會工(gong)作的,退出公(gong)務員管理(li),不再保留(liu)(liu)公(gong)務員身份(fen)。在(zai)(zai)行業(ye)協會商會兼(jian)職(zhi)(zhi)(zhi)的公(gong)務員,要限期辭去兼(jian)任(ren)職(zhi)(zhi)(zhi)務。

  行(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)全面實行(xing)勞動(dong)合同制度(du),與工(gong)作(zuo)人(ren)員(yuan)簽訂(ding)勞動(dong)合同,依法保障工(gong)作(zuo)人(ren)員(yuan)合法權益(yi)。工(gong)作(zuo)人(ren)員(yuan)的工(gong)資,由行(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)按(an)照(zhao)國家有關(guan)法律、法規和政(zheng)策確定。行(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)及其工(gong)作(zuo)人(ren)員(yuan)按(an)規定參加基本(ben)養(yang)老(lao)、基本(ben)醫療等(deng)社(she)會(hui)(hui)保險和繳存住房公(gong)積金。

  行業協會(hui)商會(hui)與行政(zheng)機關(guan)脫鉤后,使用的事業編制相應核銷(xiao)。現有(you)事業人員按國家有(you)關(guan)規定參加機關(guan)事業單位(wei)養老保(bao)險。歷次(ci)政(zheng)府(fu)機構(gou)改革分流人員仍(reng)執行原定政(zheng)策(ce)。

  (五)黨建、外事等事項(xiang)分離(li),規范管(guan)理關系

  行(xing)業(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)的(de)黨(dang)(dang)建(jian)、外事、人(ren)力資(zi)(zi)源服務(wu)(wu)等(deng)事項(xiang)與原主辦(ban)(ban)、主管(guan)(guan)(guan)、聯(lian)系和(he)掛(gua)靠(kao)單(dan)位(wei)脫(tuo)鉤(gou)(gou)(gou)。全(quan)國性(xing)行(xing)業(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)與行(xing)政(zheng)(zheng)機(ji)關(guan)(guan)(guan)脫(tuo)鉤(gou)(gou)(gou)后的(de)黨(dang)(dang)建(jian)工作,按照原業(ye)務(wu)(wu)主管(guan)(guan)(guan)單(dan)位(wei)黨(dang)(dang)的(de)關(guan)(guan)(guan)系歸口分別由中央(yang)(yang)(yang)直(zhi)屬(shu)機(ji)關(guan)(guan)(guan)工委(wei)、中央(yang)(yang)(yang)國家機(ji)關(guan)(guan)(guan)工委(wei)、國務(wu)(wu)院國資(zi)(zi)委(wei)黨(dang)(dang)委(wei)領(ling)導。地(di)方行(xing)業(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)與行(xing)政(zheng)(zheng)機(ji)關(guan)(guan)(guan)脫(tuo)鉤(gou)(gou)(gou)后的(de)黨(dang)(dang)建(jian)工作,依托各(ge)地(di)黨(dang)(dang)委(wei)組織(zhi)部門和(he)民(min)政(zheng)(zheng)部門建(jian)立社會(hui)(hui)(hui)組織(zhi)黨(dang)(dang)建(jian)工作機(ji)構統一領(ling)導;已經建(jian)立非(fei)公有(you)制(zhi)企業(ye)黨(dang)(dang)建(jian)工作機(ji)構的(de),可(ke)依托組織(zhi)部門將其(qi)與社會(hui)(hui)(hui)組織(zhi)黨(dang)(dang)建(jian)工作機(ji)構整(zheng)合為一個機(ji)構。行(xing)業(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)脫(tuo)鉤(gou)(gou)(gou)后,外事工作由住(zhu)所地(di)省(區、市)人(ren)民(min)政(zheng)(zheng)府(fu)按中央(yang)(yang)(yang)有(you)關(guan)(guan)(guan)外事管(guan)(guan)(guan)理規定(ding)執行(xing),不(bu)再經原主辦(ban)(ban)、主管(guan)(guan)(guan)、聯(lian)系和(he)掛(gua)靠(kao)單(dan)位(wei)審批。行(xing)業(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)主管(guan)(guan)(guan)和(he)主辦(ban)(ban)的(de)新聞出(chu)版單(dan)位(wei)的(de)業(ye)務(wu)(wu)管(guan)(guan)(guan)理,按照文化(hua)體制(zhi)改(gai)革相(xiang)關(guan)(guan)(guan)要求和(he)新聞出(chu)版行(xing)政(zheng)(zheng)管(guan)(guan)(guan)理部門有(you)關(guan)(guan)(guan)規定(ding)執行(xing)。人(ren)力資(zi)(zi)源服務(wu)(wu)等(deng)事項(xiang)由行(xing)業(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)住(zhu)所地(di)有(you)關(guan)(guan)(guan)部門按職能分工承擔(dan)。

  四、配套政(zheng)策

  (一)完善支持政策

  制(zhi)定有針對性的(de)扶持(chi)引導政策,加(jia)強分(fen)類指導。完善政府購買服務機制(zhi),支(zhi)持(chi)行業協會(hui)(hui)商(shang)會(hui)(hui)轉型發展。鼓勵各有關(guan)(guan)部門按照《國務院辦公廳關(guan)(guan)于(yu)政府向(xiang)社會(hui)(hui)力(li)(li)量購買服務的(de)指導意見》要求,向(xiang)符合條(tiao)件的(de)行業協會(hui)(hui)商(shang)會(hui)(hui)和其他社會(hui)(hui)力(li)(li)量購買服務,及時公布購買服務事項(xiang)和相關(guan)(guan)信息,加(jia)強績效管理。

  完(wan)善(shan)行業(ye)(ye)協會(hui)商會(hui)價格政(zheng)(zheng)策(ce),落實有關(guan)稅(shui)收政(zheng)(zheng)策(ce)。按照行政(zheng)(zheng)事(shi)業(ye)(ye)性(xing)收費管理的有關(guan)規定,規范行業(ye)(ye)協會(hui)商會(hui)承接政(zheng)(zheng)府委托的行政(zheng)(zheng)事(shi)業(ye)(ye)性(xing)收費事(shi)項。對符合條件的非營利組織落實企業(ye)(ye)所得稅(shui)優惠政(zheng)(zheng)策(ce)。

  鼓(gu)勵(li)行(xing)(xing)業(ye)協(xie)會商(shang)會參與(yu)制定相關(guan)(guan)立法、政府規(gui)劃、公共(gong)政策、行(xing)(xing)業(ye)標(biao)準和行(xing)(xing)業(ye)數(shu)據統(tong)計等(deng)事務。有關(guan)(guan)部門要充分發揮行(xing)(xing)業(ye)協(xie)會商(shang)會在行(xing)(xing)業(ye)指南制定、行(xing)(xing)業(ye)人才培(pei)養、共(gong)性技術平(ping)臺建(jian)設(she)、第三(san)方咨詢評估(gu)等(deng)方面作(zuo)用,完善對行(xing)(xing)業(ye)協(xie)會商(shang)會服務創新能力建(jian)設(she)的支持機制。

  建立(li)信(xin)息資源共享機(ji)制(zhi)。全國性行業(ye)(ye)協(xie)會(hui)商會(hui)的(de)有關(guan)行業(ye)(ye)統計(ji)數據(ju)(ju),按原規(gui)定報送國家統計(ji)局。行業(ye)(ye)協(xie)會(hui)商會(hui)應(ying)按原渠(qu)道向行業(ye)(ye)管(guan)理部(bu)(bu)門報送相關(guan)行業(ye)(ye)數據(ju)(ju)和(he)信(xin)息。有關(guan)職(zhi)能部(bu)(bu)門要建立(li)行業(ye)(ye)公共信(xin)息交(jiao)匯(hui)平臺,整合(he)全國性行業(ye)(ye)協(xie)會(hui)商會(hui)的(de)有關(guan)數據(ju)(ju),為政府制(zhi)定和(he)實施(shi)相關(guan)政策提供信(xin)息服務,為行業(ye)(ye)協(xie)會(hui)商會(hui)提供必要的(de)行業(ye)(ye)信(xin)息和(he)數據(ju)(ju)。

  支(zhi)持(chi)行業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)在進出口(kou)貿(mao)易(yi)和(he)對外(wai)經濟交(jiao)流(liu)、企業(ye)“走出去(qu)”、應對貿(mao)易(yi)摩(mo)擦等事務中,發揮(hui)協(xie)(xie)調(diao)、指(zhi)導、咨詢(xun)、服務作用。鼓勵(li)(li)行業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)參與協(xie)(xie)助政府部(bu)門多雙(shuang)邊(bian)經貿(mao)談(tan)判工作,提供(gong)相關咨詢(xun)和(he)協(xie)(xie)調(diao)服務。鼓勵(li)(li)行業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)積極(ji)搭建促進對外(wai)貿(mao)易(yi)和(he)投(tou)資等服務平臺,幫(bang)助企業(ye)開拓國際市(shi)場。

  (二)完善綜合(he)監(jian)管體制

  加強法律法規(gui)制度建設(she)。加快(kuai)推進(jin)行(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)立法工(gong)作。行(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)脫鉤(gou)后,按程序修改章程并(bing)報民政部門備案。健全(quan)行(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)退出(chu)機制,在實(shi)施脫鉤(gou)中對職能不清、業(ye)務開展(zhan)不正常、不適應經濟社會(hui)(hui)(hui)發(fa)展(zhan)的行(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)依法予以(yi)注(zhu)銷。鼓勵和促進(jin)行(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)間公平(ping)有序競爭。

  完善政(zheng)(zheng)府(fu)(fu)綜合監(jian)管(guan)(guan)(guan)體系。制定行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)綜合監(jian)管(guan)(guan)(guan)辦(ban)法(fa),健全監(jian)督(du)(du)(du)管(guan)(guan)(guan)理(li)機(ji)制。民政(zheng)(zheng)部(bu)門依照(zhao)相關(guan)(guan)(guan)(guan)登記(ji)管(guan)(guan)(guan)理(li)法(fa)規,對(dui)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)加(jia)強(qiang)登記(ji)審(shen)查(cha)、監(jian)督(du)(du)(du)管(guan)(guan)(guan)理(li)和執法(fa)檢(jian)(jian)查(cha),強(qiang)化(hua)對(dui)主要負責(ze)人任職(zhi)條(tiao)件和任用程(cheng)序的(de)(de)監(jian)督(du)(du)(du)管(guan)(guan)(guan)理(li)。財(cai)政(zheng)(zheng)部(bu)門負責(ze)對(dui)政(zheng)(zheng)府(fu)(fu)購買(mai)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)服務(wu)的(de)(de)資金和行(xing)(xing)(xing)(xing)(xing)(xing)(xing)為進(jin)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)評估和監(jian)管(guan)(guan)(guan),并會(hui)(hui)(hui)(hui)(hui)(hui)同機(ji)關(guan)(guan)(guan)(guan)事務(wu)主管(guan)(guan)(guan)部(bu)門對(dui)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)使用的(de)(de)國有資產(chan)進(jin)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)登記(ji)和監(jian)管(guan)(guan)(guan)。稅(shui)務(wu)部(bu)門對(dui)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)涉稅(shui)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)為進(jin)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)稽查(cha)和監(jian)管(guan)(guan)(guan)。審(shen)計(ji)部(bu)門對(dui)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)依法(fa)進(jin)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)審(shen)計(ji)監(jian)督(du)(du)(du)。價格(ge)部(bu)門對(dui)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)收費及價格(ge)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)為進(jin)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)監(jian)管(guan)(guan)(guan)。行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)組織論(lun)壇、評比、達標、表(biao)彰等活(huo)動(dong),要嚴格(ge)按相關(guan)(guan)(guan)(guan)規定執行(xing)(xing)(xing)(xing)(xing)(xing)(xing),并接受(shou)監(jian)督(du)(du)(du)。各(ge)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)管(guan)(guan)(guan)理(li)部(bu)門按職(zhi)能對(dui)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)進(jin)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)策和業(ye)(ye)務(wu)指(zhi)導,并履行(xing)(xing)(xing)(xing)(xing)(xing)(xing)相關(guan)(guan)(guan)(guan)監(jian)管(guan)(guan)(guan)責(ze)任。其(qi)他職(zhi)能部(bu)門和地方政(zheng)(zheng)府(fu)(fu)按職(zhi)能分工對(dui)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)(hui)進(jin)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)監(jian)管(guan)(guan)(guan)。黨的(de)(de)各(ge)級紀(ji)檢(jian)(jian)機(ji)關(guan)(guan)(guan)(guan)加(jia)強(qiang)監(jian)督(du)(du)(du)執紀(ji)問責(ze)。探索(suo)建立專業(ye)(ye)化(hua)、社(she)會(hui)(hui)(hui)(hui)(hui)(hui)化(hua)的(de)(de)第三(san)方監(jian)督(du)(du)(du)機(ji)制。

  完善信用(yong)體系和信息公開制(zhi)度(du)(du)(du)。建(jian)(jian)(jian)立行(xing)業(ye)(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)信用(yong)承諾制(zhi)度(du)(du)(du),完善行(xing)業(ye)(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)的信用(yong)記錄,建(jian)(jian)(jian)立綜(zong)合(he)信用(yong)評級制(zhi)度(du)(du)(du)。對行(xing)業(ye)(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)的信用(yong)情況開展社會(hui)(hui)(hui)評價(jia),評價(jia)結果向社會(hui)(hui)(hui)公布。建(jian)(jian)(jian)立健全行(xing)業(ye)(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)信息公開和年度(du)(du)(du)報告制(zhi)度(du)(du)(du),接受社會(hui)(hui)(hui)監督。

  建立(li)完(wan)(wan)(wan)善法人治(zhi)(zhi)理(li)(li)結構。行(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)要(yao)(yao)(yao)按(an)照建立(li)現代社(she)會(hui)(hui)(hui)組(zu)織要(yao)(yao)(yao)求,建立(li)和(he)完(wan)(wan)(wan)善產(chan)權清(qing)晰、權責(ze)明確(que)、運轉協調(diao)、制(zhi)衡有(you)效的法人治(zhi)(zhi)理(li)(li)結構。健全行(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)章程審(shen)核(he)備案機制(zhi),完(wan)(wan)(wan)善以(yi)章程為核(he)心(xin)的內部管理(li)(li)制(zhi)度(du)(du)(du),健全會(hui)(hui)(hui)員大(da)會(hui)(hui)(hui)(會(hui)(hui)(hui)員代表大(da)會(hui)(hui)(hui))、理(li)(li)事(shi)(shi)(shi)會(hui)(hui)(hui)(常務理(li)(li)事(shi)(shi)(shi)會(hui)(hui)(hui))制(zhi)度(du)(du)(du),建立(li)和(he)健全監(jian)(jian)(jian)(jian)事(shi)(shi)(shi)會(hui)(hui)(hui)(監(jian)(jian)(jian)(jian)事(shi)(shi)(shi))制(zhi)度(du)(du)(du)。落(luo)實(shi)(shi)民主(zhu)選(xuan)(xuan)舉(ju)(ju)、差額選(xuan)(xuan)舉(ju)(ju)和(he)無記名投(tou)票制(zhi)度(du)(du)(du)。鼓勵選(xuan)(xuan)舉(ju)(ju)企業家擔任行(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)理(li)(li)事(shi)(shi)(shi)長,探索實(shi)(shi)行(xing)(xing)理(li)(li)事(shi)(shi)(shi)長(會(hui)(hui)(hui)長)輪值(zhi)制(zhi),推行(xing)(xing)秘書(shu)長聘任制(zhi)。實(shi)(shi)施(shi)法定代表人述職(zhi)、主(zhu)要(yao)(yao)(yao)負責(ze)人任職(zhi)前公示和(he)過錯(cuo)責(ze)任追(zhui)究制(zhi)度(du)(du)(du)。在重要(yao)(yao)(yao)的行(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)試行(xing)(xing)委派監(jian)(jian)(jian)(jian)事(shi)(shi)(shi)制(zhi)度(du)(du)(du),委派監(jian)(jian)(jian)(jian)事(shi)(shi)(shi)履行(xing)(xing)監(jian)(jian)(jian)(jian)督(du)和(he)指導職(zhi)責(ze),督(du)促(cu)行(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)落(luo)實(shi)(shi)宏觀調(diao)控政(zheng)策和(he)行(xing)(xing)業政(zheng)策。所派監(jian)(jian)(jian)(jian)事(shi)(shi)(shi)不在行(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)兼(jian)職(zhi)、取酬、享受福利。

  五、組(zu)織實(shi)施

  (一)建立工作機制(zhi)

  國(guo)(guo)家發展(zhan)改革(ge)委(wei)(wei)、民政(zheng)部會同中央組(zu)(zu)織部、中央編(bian)辦(ban)、中央直(zhi)屬(shu)機(ji)(ji)關(guan)工(gong)(gong)委(wei)(wei)、中央國(guo)(guo)家機(ji)(ji)關(guan)工(gong)(gong)委(wei)(wei)、外交(jiao)部、工(gong)(gong)業(ye)和(he)(he)信息(xi)化部、財政(zheng)部、人力資源(yuan)社會保障部、商務部、審計署、國(guo)(guo)務院國(guo)(guo)資委(wei)(wei)、國(guo)(guo)管局(ju)、全國(guo)(guo)工(gong)(gong)商聯,成(cheng)立行業(ye)協會商會與行政(zheng)機(ji)(ji)關(guan)脫(tuo)(tuo)鉤(gou)聯合(he)工(gong)(gong)作(zuo)組(zu)(zu)(以(yi)下(xia)簡稱聯合(he)工(gong)(gong)作(zuo)組(zu)(zu)),負責組(zu)(zu)織實施(shi)本方案,推進全國(guo)(guo)性行業(ye)協會商會脫(tuo)(tuo)鉤(gou)工(gong)(gong)作(zuo),指(zhi)導和(he)(he)督促各地開展(zhan)脫(tuo)(tuo)鉤(gou)工(gong)(gong)作(zuo)。聯合(he)工(gong)(gong)作(zuo)組(zu)(zu)由國(guo)(guo)務院領導同志牽(qian)頭(tou),辦(ban)公室(shi)設在國(guo)(guo)家發展(zhan)改革(ge)委(wei)(wei)。各地建立相應領導機(ji)(ji)制(zhi)和(he)(he)工(gong)(gong)作(zuo)組(zu)(zu),制(zhi)定本地區脫(tuo)(tuo)鉤(gou)方案,負責推進本地區脫(tuo)(tuo)鉤(gou)工(gong)(gong)作(zuo)。

  (二)明確(que)責任分工

  各相(xiang)(xiang)關(guan)職能部(bu)門(men)按(an)照(zhao)本(ben)方案(an)和職能分工(gong),落(luo)實相(xiang)(xiang)關(guan)政(zheng)策和措施。各級(ji)發展改革、民政(zheng)部(bu)門(men)負(fu)責(ze)(ze)統籌協調、督(du)促檢查脫鉤工(gong)作。審計(ji)部(bu)門(men)負(fu)責(ze)(ze)對資(zi)產清查結(jie)果進行抽查監督(du),審計(ji)脫鉤過程中財(cai)政(zheng)資(zi)金使用情(qing)況。各業(ye)務主管(guan)單位負(fu)責(ze)(ze)逐個制(zhi)定行業(ye)協會(hui)商會(hui)脫鉤實施方案(an),落(luo)實各項工(gong)作,并(bing)向社會(hui)公開(kai)。

  為適應行業協會商會脫鉤后的新體制(zhi)(zhi)新要求,國家(jia)發展(zhan)改革委、民政部(bu)會同(tong)有關部(bu)門(men)制(zhi)(zhi)定(ding)綜(zong)合監管(guan)辦法(fa)。

  (三)穩妥開展(zhan)試(shi)點

  全國(guo)性(xing)行(xing)業協會(hui)商會(hui)脫(tuo)鉤試(shi)(shi)點(dian)工作由(you)民政部牽頭負責(ze),2015年下半年開始第一批(pi)試(shi)(shi)點(dian),2016年總結(jie)經驗、擴大(da)試(shi)(shi)點(dian),2017年在更大(da)范圍試(shi)(shi)點(dian),通(tong)過試(shi)(shi)點(dian)完善相(xiang)應的(de)體(ti)制(zhi)機制(zhi)后(hou)(hou)全面推開。按(an)照兼顧(gu)不(bu)同(tong)類型、行(xing)業和部門的(de)原則,第一批(pi)選擇100個(ge)左右全國(guo)性(xing)行(xing)業協會(hui)商會(hui)開展脫(tuo)鉤試(shi)(shi)點(dian)。各業務主管單位于2015年7月(yue)底前(qian)(qian)將推薦試(shi)(shi)點(dian)名單報送民政部,并(bing)(bing)逐(zhu)個(ge)制(zhi)定試(shi)(shi)點(dian)行(xing)業協會(hui)商會(hui)脫(tuo)鉤實施(shi)方案。方案報經民政部核(he)準、聯合工作組批(pi)復后(hou)(hou)實施(shi),其中須有關部門批(pi)準的(de)事項,按(an)管理權限和職(zhi)能(neng)分別報批(pi)。各試(shi)(shi)點(dian)單位要在2016年6月(yue)底前(qian)(qian)完成(cheng)第一批(pi)試(shi)(shi)點(dian),由(you)聯合工作組對試(shi)(shi)點(dian)成(cheng)效進行(xing)評估并(bing)(bing)認真總結(jie)經驗,完善配套政策。

  地方行業(ye)協(xie)會商會脫(tuo)(tuo)鉤(gou)試(shi)(shi)點(dian)工(gong)作(zuo)由各(ge)省(sheng)(區(qu)、市)工(gong)作(zuo)組(zu)負責。各(ge)省(sheng)(區(qu)、市)同步開展(zhan)本地區(qu)脫(tuo)(tuo)鉤(gou)試(shi)(shi)點(dian)工(gong)作(zuo),首先(xian)選(xuan)擇幾個省(sheng)一級協(xie)會開展(zhan)試(shi)(shi)點(dian),試(shi)(shi)點(dian)方案報(bao)經民政部核準、聯(lian)(lian)合(he)工(gong)作(zuo)組(zu)批(pi)復后實施(shi)。各(ge)地要在2016年底前完(wan)成第(di)一批(pi)試(shi)(shi)點(dian)和評(ping)估,并(bing)將評(ping)估結(jie)果報(bao)聯(lian)(lian)合(he)工(gong)作(zuo)組(zu)。在認(ren)真總結(jie)經驗(yan)的基礎上,完(wan)善(shan)試(shi)(shi)點(dian)政策,逐步擴(kuo)大(da)試(shi)(shi)點(dian)范(fan)圍,穩(wen)妥審慎推開。

  (四)精(jing)心組(zu)織實施

  脫(tuo)鉤(gou)工作(zuo)(zuo)涉及(ji)面(mian)廣、政策性(xing)強、社會關(guan)注度(du)高(gao),各(ge)地區、各(ge)有(you)(you)關(guan)部門(men)和(he)行業協會商會要(yao)(yao)高(gao)度(du)重視,嚴(yan)明紀律,做好(hao)風險預案,確保如期完成脫(tuo)鉤(gou)任務。要(yao)(yao)嚴(yan)格按照本方案要(yao)(yao)求推進脫(tuo)鉤(gou)工作(zuo)(zuo),規范工作(zuo)(zuo)程序(xu),建(jian)立考核機制,確保工作(zuo)(zuo)有(you)(you)序(xu)開展。要(yao)(yao)加強輿論引導(dao)和(he)政策解讀,形成良好(hao)輿論氛圍。脫(tuo)鉤(gou)工作(zuo)(zuo)中遇有(you)(you)重要(yao)(yao)情況和(he)問(wen)題,要(yao)(yao)及(ji)時(shi)向聯合(he)工作(zuo)(zuo)組報告。

  各地區(qu)、各部(bu)門(men)要大力支(zhi)持行(xing)業(ye)協(xie)(xie)會(hui)商(shang)(shang)(shang)會(hui)發(fa)展,優化(hua)發(fa)展環(huan)境,改進工作(zuo)方式,構(gou)建(jian)與行(xing)業(ye)協(xie)(xie)會(hui)商(shang)(shang)(shang)會(hui)新型(xing)合作(zuo)關系;建(jian)立和完善與行(xing)業(ye)協(xie)(xie)會(hui)商(shang)(shang)(shang)會(hui)協(xie)(xie)商(shang)(shang)(shang)機制(zhi),在(zai)研究(jiu)重大問(wen)題和制(zhi)定相(xiang)關法(fa)律(lv)法(fa)規、規劃、政策時應主(zhu)動聽取相(xiang)關行(xing)業(ye)協(xie)(xie)會(hui)商(shang)(shang)(shang)會(hui)意見;加強對(dui)行(xing)業(ye)協(xie)(xie)會(hui)商(shang)(shang)(shang)會(hui)的指導和支(zhi)持,及時研究(jiu)解(jie)決行(xing)業(ye)協(xie)(xie)會(hui)商(shang)(shang)(shang)會(hui)改革發(fa)展中的困難和問(wen)題。行(xing)業(ye)協(xie)(xie)會(hui)商(shang)(shang)(shang)會(hui)要加快轉型(xing),努力適應新常(chang)態、新規則、新要求,完善治理結構(gou),規范(fan)(fan)自身行(xing)為,提升專業(ye)服務(wu)水平(ping),強化(hua)行(xing)業(ye)自律(lv),引(yin)導企業(ye)規范(fan)(fan)經(jing)營,積極反映會(hui)員(yuan)訴求,維(wei)護會(hui)員(yuan)合法(fa)權益,真正成為依法(fa)自治的現代社會(hui)組(zu)織。

  自本方案印發之日起(qi),新設立(li)的行業協會(hui)商會(hui),按本方案要(yao)求執行。
